Terms of Service

1. Acceptance of terms

By accessing or using oeYYeo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Accounts and age

To chat you must create an account. You are responsible for keeping your credentials confidential and for all activity under your account.

• You must provide accurate and complete information when you register, including your year of birth
• You must be at least 13 years old to hold an account. We do not knowingly create accounts for children under 13
• Chat is 18+. Chat is the whole of oeYYeo, so if you are under 18 you may read the site, but you cannot send a message to a character
• We apply both limits from the year of birth you give us. We do not check it against a document, so it depends on an honest answer. Giving a false one may cost you the account
• If you are under 18, a parent or guardian can email support@oeyyeo.com to see, correct or delete your account and the information we hold about you. Our Privacy Policy explains how that works
• You must notify us immediately of any unauthorized use of your account

3. Payment terms

3.1 The plan

Creating an account and talking with the cast is free to start. The oeYYeo plan costs $9.99 a month, billed monthly. What the plan includes is stated on the pricing page at the time you subscribe, and anything that is plan-only becomes unavailable when the plan ends.

3.2 Recurring billing

• By subscribing you authorize us to charge your payment method when you subscribe and again at the start of each monthly billing period
• The plan renews automatically each month until you cancel
• You are responsible for keeping your payment method current and valid; if it expires or is declined, update it promptly
• If a renewal payment fails, the payment may be retried, and we email you when that happens

3.3 Cancellation

• You can cancel at any time. Cancelling stops the next charge, and you keep the plan until the end of the period you already paid for
• No partial refunds are issued for the unused portion of a billing period
• Deleting your account cancels the plan and does not refund the current period

3.4 Price changes

We may change the price of the plan. If we raise the price of your plan, we will email you between 7 and 30 days before the new price takes effect, and that email will tell you how to cancel. If you do not want to pay the new price, cancel before it takes effect and you will not be charged it.

3.5 Refunds

Payments are for the period you already received and are not refunded. Cancelling stops the next charge. If you think a charge is wrong, email support@oeyyeo.com.

4. Intellectual property

The oeYYeo name, wordmark, site and the brand's own cast of characters, including their names, likenesses, stories and lines, belong to oeYYeo and are protected by applicable intellectual property laws. You may talk with them; you may not copy them, sell them or present them as your own.

If character creation is offered to you, you retain ownership of the characters you create. By publishing a character you grant oeYYeo a non-exclusive, worldwide license to display, distribute and promote it on the Service.

Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to support@oeyyeo.com that includes: a description of the copyrighted work, the location of the allegedly infringing content, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement that the information in your notice is accurate. We review valid notices and remove or restrict infringing content where appropriate, and we terminate the accounts of repeat infringers.

5. Prohibited content and conduct

You may not use the Service to:

• Create or publish a character that is, or is a renamed version of, a character from any existing anime, manga, game, film, comic or other work
• Create or publish a character based on a real person, living or dead, or use a real person's name, image, voice or likeness
• Create, describe or depict any character as under 18, or with school, childlike or age-ambiguous framing, whatever the content of the chat
• Attempt to obtain sexual content involving anyone who is, or could be read as, a minor
• Publish content that infringes on others' intellectual property rights
• Upload harmful, abusive or illegal content
• Misrepresent AI-generated content as real communications from actual people
• Attempt to circumvent the 18+ rule, our safety systems, platform security or payment systems
• Engage in fraud, phishing or deceptive practices
• Harass, bully or threaten other users

Violation of these terms may result in account suspension or termination without refund.

6. Dispute resolution

6.1 Payment disputes

If you have a dispute regarding a payment or charge, contact us at support@oeyyeo.com before initiating a chargeback with your bank. We are committed to resolving issues fairly and promptly.

6.2 Content disputes

If you believe content on the Service infringes your intellectual property or violates our guidelines, contact support@oeyyeo.com with details. See Section 4 for our copyright complaint process.

6.3 Negotiation first

Before pursuing formal proceedings, you agree to first contact us at support@oeyyeo.com so we can try to resolve the dispute through good-faith negotiation. Governing law, binding arbitration and the class action waiver are set out in Section 13.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, oeYYeo, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Damages arising from AI-generated content, including any actions taken based on something a character said
• Emotional, psychological or mental health impacts resulting from interactions with characters
• Loss of data, revenue, profits or business opportunities
• Any harm resulting from unauthorized access to or alteration of your data or transmissions
• Any failure of AI safety systems, content moderation or crisis detection features
• The conduct of any third party on the Service, including other users and AI-generated content

Conversations with characters are fiction offered for entertainment. They are not professional advice of any kind, and you rely on them entirely at your own risk.

IN NO EVENT SHALL oeYYeo's TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO oeYYeo IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. AI content disclaimer

Every character on oeYYeo is generated by artificial intelligence. By using the Service you acknowledge and agree to the following:

8.1 What a character is

• Characters are simulations, not real people. They are computer-generated. They are not real people, do not represent real people, do not have consciousness, emotions, feelings or awareness, and cannot form genuine relationships with you. Every reply is generated, not written by a human
• Replies are generated and may be inaccurate. They may be inaccurate, incomplete or misleading. Do not rely on them as fact
• Fiction, for conversation and story. Characters are written to stay in character and to keep to their own world. They decline romantic and sexual roleplay
• No substitute for people. A conversation with a character is not a substitute for human relationships, professional counseling, therapy or any form of human support
• No endorsement. The views, opinions or statements a character expresses do not reflect the views of oeYYeo

8.2 Not professional advice

• Replies do not constitute, and should never be relied upon as, medical, psychological, psychiatric, legal, financial or any other form of professional advice
• If you or someone else is in crisis, experiencing suicidal thoughts or thinking about self-harm, contact the 988 Suicide and Crisis Lifeline (call or text 988), the Crisis Text Line (text HOME to 741741), or your local emergency services. Outside the United States, find a helpline at findahelpline.com. See our Safety page
• oeYYeo is not a crisis service, healthcare provider, mental health service or counseling service. Surfacing crisis resources does not make us one, and no conversation with a character is a substitute for professional care or emergency services
• No conversation on the Service creates a doctor-patient, therapist-client, attorney-client or any other professional relationship

8.3 Safety measures and content moderation

• We run automated safety systems, including crisis keyword detection that may surface mental health resources during a conversation
• No automated system is perfect. A character may occasionally produce an unexpected, inappropriate or harmful reply
• Report any concerning, harmful or inappropriate reply to support@oeyyeo.com
• We may monitor, review and moderate conversations for safety purposes, and conversation data may be used to improve safety systems and content moderation

8.4 Users under 18

• Chat is 18+. An account whose year of birth puts its holder under 18 cannot send messages to a character
• We apply this from the year of birth you give us, which we do not check against a document. Giving a false one may cost you the account
• Parents and guardians: email support@oeyyeo.com to see, correct or delete a minor's account and the information we hold about it

8.5 Your responsibilities

• You understand that characters are not sentient and that forming emotional dependence on them is not the intended use of the Service
• You agree not to use the Service to generate harmful, illegal, sexually explicit or dangerous content
• You agree not to attempt to manipulate a character into producing content that violates our safety guidelines or content policies
• You are solely responsible for how you interpret and act on anything a character says
• You agree not to misrepresent a character's replies as communications from a real person

9. Data handling and privacy

Our collection, use and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We collect and process the personal data needed to provide the Service, including account information, payment details and usage data
• Payment information is processed securely by a third-party payment processor, and full card numbers are not stored on our servers
• Conversations may be stored to provide your history and to improve safety, subject to our retention policy
• You can delete your account yourself from your account page, or request deletion of your personal data by emailing support@oeyyeo.com
• We do not sell your personal information to third parties

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination:

• Your access to the plan may be revoked
• You remain responsible for any outstanding charges
• Your personal information is handled as our Privacy Policy describes

11. Indemnification

You agree to indemnify, defend and hold harmless oeYYeo, its officers, directors, employees, agents, affiliates and licensors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of or inability to use the Service
• Your violation of these Terms or any applicable law or regulation
• Your violation of any rights of any third party
• Any content you submit, post or transmit through the Service
• Any misuse of AI-generated content, including reliance on a character's replies as professional advice
• Your failure to provide accurate registration information, including age
• A minor's use of the Service under your account or with your consent

12. Assumption of risk

By using the Service, you acknowledge and agree that:

• AI technology is inherently unpredictable and may produce unexpected, inaccurate or inappropriate outputs despite safety measures
• You voluntarily assume all risks associated with using AI-powered features, including risks related to content accuracy, emotional impact and reliance on AI-generated information
• Our safety features (including crisis detection, content moderation and age-based restrictions) do not guarantee the prevention of all potentially harmful content or interactions
• You have been informed that characters are not real entities and cannot provide genuine emotional support, medical advice or crisis intervention
• You are responsible for your own well-being and should seek appropriate professional help for any medical, psychological, legal or financial matter

13. Arbitration and class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and oeYYeo agree that any dispute, claim or controversy arising out of or relating to these Terms or the use of the Service shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property infringement.

• No class actions: disputes will be resolved only on an individual basis and not in a class, consolidated or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration
• Arbitration rules: arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• Small claims exception: either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits
• Opt-out: you may opt out of this arbitration agreement by sending written notice to support@oeyyeo.com within 30 days of creating your account. Your notice must include your name, email and a clear statement that you wish to opt out of arbitration
• Severability: if the class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void

Governing law: these Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in Wayne County, Michigan.

14. General provisions

• Entire agreement: these Terms, together with the Privacy Policy and any policies referenced here, are the entire agreement between you and oeYYeo regarding the Service and supersede any prior agreements
• Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect
• Waiver: our failure to enforce any provision is not a waiver of our right to do so later
• Assignment: you may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition or sale of assets
• No third-party beneficiaries: these Terms do not create any rights for anyone other than you and oeYYeo
• Notices: we may provide notices to you by email or by posting them on the Service. You may contact us at support@oeyyeo.com
• Survival: provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution) survive
